Sending someone to collections... anyone done it?

I have a guy that owes me $900, he's owed me for about a year now, and refuses to answer email/phone calls/etc.

Anyone know what the process is in Cali to send his sorry ass to collections?

Do I need to sue him in small claims court first, so that I have a judgement in my favor for the money?

I do have bounced check for the amount, can I just use that?

we take people to court all the time. we have an attorney on retainer and just send the file over to them and they take care of it from there.

we do have to go to court at times to testify, so have all your crap together if you do decide to go that route.

do you have a business? IF not you need to take him to small claims.

I wanna think $900 is above the threshold for small claims. I took business law three years ago so I can be mistaken.

Google a collections template letter and send it certified letter first. A collections agency is gonna do the same and then charge you a fee.

I doubt that - he originally owed me $1800, and gave me two $900 checks. The first one cleared, the second one bounced. I would assume that the bounced check shows that he at least had intent to pay at one point, even if he's basically fled now.

Take him to court for it and add the court cost to the judgment. Keeps you from having to pay for a collection agency first off. (I'm assuming they take a cut of the money you get or a fee)

Fled...meaning you do not know where to find him, yes? I do not know how you take someone to court without knowing where they are. Police may help with that. I really hope you get your money...I hate people stealing becuz he has in fact stolen from you.

Well, I know where he is. However, he refuses to respond to any of the ways I know how to contact him.

I do have one 'in', in that he just moved in with a good friend of a good friend of mine.

My plan is to send him the certified letter of translateToLegalese("You owe me this much, pay it by this date, or see me in court") once I get the address to send it to.

uhh, present your case to judge joe brown or one of those shows... just be like, I want to sue this guy for not paying, is there anything y'all can do to help

that way you get a nice little vaca and your money.
