It is a moving violation. Go to court, plead not guilty, get a lawyer, pay his outlandish fees, get it reduced to defective equipment or a seatbelt violation, keep all your points and don't pay more per month on insurance.

Then, if you're feelin' froggy, file harassment charges on the cop... lol. No, don't do that last one. Do, however, fight it out in court w/ an attorney at your aide.

lol what do i say in court i he wrote a quote on the ticket that says i said "i was speeding 37 or 38"
he quoted himself saying "i observed the vehicle at 40 mph south bound on bridge street near landos bar with numerous people in the sidewalk and roadway area..."
charge based on officer direct observation

Just show up and when they call your name, say, and you can quote me on this:

"Not guilty. I wish to seek legal coucil." "No your honor, I do not require a court appointed attorney. I will seek legal guidance of my own." "Thank you your honor."

Then find a lawyer that does minor traffic infractions and be on your way.

Yes, in the short term, but it is a moving violation. That will impact your insurance rate for at least 3 years. It will go up. Bottom line. You get a moving violation, your insurance gets hiked. And it will take points off of your license. You only get 7 to start with. Most moving violations are 1-2 points. Then they go up from there.

Say you just pay the fine, lose a point. No biggie. Then you get stopped again and its for failure to yield. You just wanna pay the fine there too, but you have a prior moving violation. Hmmm... Now you have to go to court. You will be considered a repeat offender. And the points will be more. Traffic school, insurance provider may drop you, at the least, you will be out into a different catagory w/ them. Then, you get to pay the big bucks to keep coverage.

Now, say you go to court for the cross walk thing. It gets turned into a non moving violation. You get defective equipment. Nobody cares about that. It will never be a factor with law enforcement or your insurance.

I have been to court many times for similiar things. Yeah, up front its cheaper to just pay the fine, but man, in the long run, the $350 or so you pay to the court and a lawyer, that ain't nothin' compared to skyrocket insurance rates and know that if you so much as don't dim your brights, the cops are gonna cite ya, shit. It is a headache.

Do what you wanna do, but thats my advice bro. Take it or leave it. I ain't here to preach, just the devils advocate.

I am merely specualting what you will pay. the attorney shouldn't be more than $100-$150. Tack on the court costs and the price for a defective equipment. My guess is somewhere around $350 GRAND TOTAL. Lawyer, fees, court costs, ticket costs, etc.

It may get thrown out. If Johnny Law isn't at court on the day you go, the jugde may just dismiss the whole damn thing.

it may be cheaper than what I think. Thats been about the average I have run across. $350 total. Being that your ticket isn't very well put together, you will have a really good chance of not haveing any fees go to the city/court/county/whoever. Just your lawyer fee and court costs. Nothing more.

Did the cop cite you for not having your wallet/driver's license? If he did that could raise a few problems when you want to fight the ticket.

If not, then hey, the less they know the easier it is for you.

I have no idea bro. You're in NY I'm like 3000miles southwest of ya in MO lol.

Did the cop leave you with a cheat sheet, with the prices of fines, or is it to come in the mail? Look on the back of the ticket and see if there is a phone# to the court house, or a web address that has contact info. Call the # or hit the site. See if you can get the $ amount for any given infraction. That will be a good starting point.

Tomorrow, grab the yellowpages and start makin phone calls to attorneys. Don't just go with the first one. Call at least 6-8 different ones.

Careful, some may want a fee upfront, even to just ask them if they will represent you. It typically isn't more than $25-$50 and they will consider that part of their fee for representation. If you call them, then you will know right up front if they charge per hour or offense. When you decide on one, tell them everything. EVERYTHING. That you were only there to take a leak, were coming from G/F's house, the whole 9yards.

Don't wear blue jeans and a T-shirt. Hold your head high. Don't look guilty. Assume your are innocent. Don't be all meek and scared. You ain't goin to jail. Be confident. The judge will see that.

thats not always true, I got a 45 mph over ticket back in 2005 and somehow my insurance never went up, GotBoost232 definitely dont voluntarily tell your insurance about the ticket and you may get away with it
