Man Arrested After Posting 195 MPH Corvette Run On YouTube

After seeing that, I had 3 thoughts.

1. Whoever called the cops is pathetic, no life.
2. That Corvette is fucking fast
3. I want to move to Oklahoma after seeing roads that fucking empty.

Sucks for him, but it was stupid of him posting it, but yet who would acually waste their time to call the cops

also our roads near the cities are pretty packed, but get 20-25 miles off the city, and they are usually open like that.

Alright, it is 7 o'clock in the morning, but I'll stretch my lawyer legs and take a swing at this. This counts as Bar Study time right? lol His defense attorney has his work cut out for him, but at first blush, I think he does have some defenses:

1) The State (Prosecutor/D.A.) has to prove that this occurred in the county in which he is going to be prosecuted in. Doesn't seem like a very hard hurdle because of the landmarks at the beginning (bridge, on-ramp, car dealership) but still the Defendant's attorney could show pictures of another town with substantially similar landmarks to rebut their contention that he was speeding in XXX, OK.

2) Then the State has to prove that it was actually him in the video. It doesn't show his face, but you do hear his voice which could be used to identify him. The Defendant could say that a friend drove it that fast for him and just gave him the video.

3) Then the State has to prove that he was actually going as fast as they say he is. Even though he does admit that it was 195+ mph, this is hearsay (an out of court statement to prove the truth of the matter asserted, i.e., that he's going 195+ mph). But even though it is hearsay, it will likely fall under one of the exceptions to the hearsay rule because it is a "statement against interests." His best defense to that is to argue that he wasn't really going that fast but simply bragging beyond its capabilities in order to facilitate a sale (i.e., puffery).

4) The State will also have to prove that this video was taped within the Statute of Limitations. I have no clue what it is in OK for whatever offense he's been charged with, but upgrades to the road and/or surrounding structures (and especially the year models of the cars on the lot of that dealership) will most likely help the State to prove this element.

5) Also, the State will have to authenticate the video, and prove that it wasn't altered or sped up in order to make the car appear to be going faster than it actually was. Since they got it from youtube, it is likely that most of the properties and quality is degraded enough to call that into question.

There may be other stuff but I only watched the video once so if you guys think of anything else, point it out and we'll talk about it.

Now before everyone starts a flame war about how I want to keep some retard on the street endangering lives, shut up. All this is meant for is to show what procedures are in place that a defendant can use to ensure that innocent people are not put in jail. Even if the jury finds him "not guilty" that does NOT mean innocent. It just means that the State didn't meet the burden required by our Constitution that safeguards the freedom of innocent men/women. We would rather 5 guilty men go free rather than put 1 innocent man in jail. If you don't like our Constitution, take it up with your Congressman because I don't make the rules, I just play by them.
