HOAs aren't that bad if they are run by people who aren't crazy. It's just important to do the research and make sure the HOA isn't nuts which is pretty easy. They do have their purpose. My neighborhood is much nicer than the one next to it, very similarly built homes, but the other does not have a HOA. Not saying that's it or completely attributable to the HOA. All of the homes in my neighborhood are nice, well maintained, and my HOA is pretty laid back. I work on my car all of the time, no one ever says anything. People compliment us on our cars and even how mine sounds. I wash my car / dry it between 7-9 PM with a blower and no one says anything. The OPs on the other hand, crazy people!

If your HOA gets much worse consider consulting your local ACLU.

My Aunt who lives in a Nazi HOA neighborhood put up a swing set in their backyard for her two little girls. They got a notice from their HOA to take it down. The girls cried and cried as their dad had to take it down.

In the same neighborhood there was a girl who was diagnosed with some sort of muscle disorder. She needed to soak in a hot tub so she wouldn't be in pain. Her family got her one so she could get in it. The same HOA told them they had to remove it and fined them and stuff.

That second one, the family went and got help from the ACLU, last I heard... the hot tub was still there.

As crazy as all of these HOAs are, and impose ridiculous rules, you have to remember that they aren't enforcing rules that you didn't agree to when moving into the neighborhood. HOAs are based in Contract Law because you each signed the agreement.

I'm not knocking on you OP, because this is most definitely a ridiculous provision, and this isn't even directed at you but just the general populace that might consider moving into such a neighborhood. When considering moving into a neighborhood with an HOA, inform them of the conditions that you do not agree to and cross them off of the agreement. If they allow you to move in after that, then you aren't bound by those terms. If that's a deal breaker for either them or you, then don't move into the neighborhood and under the HOAs control.

They have no power or control over you unless you allow them to...

Wait is a HOA a landlord?
A HOA is an association that is in charge of keeping up a neighborhood. The benifit to the home owner is that the HOA is going to keep the houses looking nicer and the neighborhood looking good. If you own a house, your property is worth more if the neighbor houses are kept up than if they're yards are full of trash.

If you live in a neighborhood, a BASIC HOA is nice. Something that doesn't allow yards to grow 2' tall and keeps massive amounts of junk out of yards. The problem is that no HOA makes just basic rules. They want to control where you can put up a fence, what type of fence, where you can park cars, how many cars you can park, what you can put in your yard, etc.

I've read MANY MANY stories about people getting fined by HOA. But I've never met a person that was made to pay that fine. I know several people that have been fined by their HOA (in different HOA), but they refuse to pay or do anything about the "problem" and all that happens is the HOA bitches at them.

They are not taking away any of your rights. You are WILLINGLY giving them up when you sign the contract. No rights are being taken away when you willingly allow it to happen. Do you think the police are taking away your rights if you allow them to search your house w/out a warrent?

We looked at a house in an area that had a HOA. We got through like 3 of many the retarded rules and walked the f out. If I'm shelling out that kind of money I'll do what I want on my property. They seemed like a bunch of assholes anyway.

Not quite. A lot of times HOAs fail to send paperwork and people don't ever sign them at time of closing. I simply didn't sign mine and I was never hassled or told I needed to sign it. I've been here for a year and paid my dues, never once was I asked. Another thing to think about is that a lot of times rules are changed while you are living there. Maybe you were in agreeance back than but not now. From a law standpoint I don't understand how a HOA can enforce a law that you didn't sign and agree to but I've seen it happen in HOAs.

Some contracts require you to perform an action that equals acceptance of a contract. By moving into a neighbor you could be doing the action that is equivalent to acceptance of the contract. You don't always need a signature to agree to something.
