This is a fucking joke. You know why.... because insurance company's NEVER pay out that much anyway. Im angry beyond all belief with my lawsuit. The guy who hit me had 100,000 dollar policy. It took 3 months off work and daily therapy to get my head back on straight. You know what All State offered me?? $11,000!!!!!! It didnt even cover 1/3 of the bill! Whats the point in having $100,000 policies ( and to to say its to help the VICTIM) if the insurance company dooesnt pay it out?

Florida is stupid. The insurance lobbiest have obviously gotten to the decision makers because they are the ones who profit from higher rates.

This has nothing to do with drunk drivers... I hate them too. I dont even drink. This is greed and politics gone bad....

All State was his carrier. He was driving a truck full of wheel chairs for his company. He hit me from behind at a stoplight doing 40 mph. The last thing I seen in my mirror was him "yacking" into his blue tooth stuck in his ear. He told the cop on the scene that "his boss gave him too much to do and he was in too big of a hurry to stop for the light".

C-6 in my spine.
Consussion.
Blurred vision for 6 months.
Loss of pay.
Trauma to the pancrease from the lap belt that will never heal due to calcification.
Loss of status at work due to doctors and time off.
The list goes on and on...

The point is that the company that hit me has a $100,000 with All State. All State offers me $11,000 for all this.

I'll be dealing with this the rest of my life.

They can burn a hot , firey violent death in hell.

No, i havent signed anything for compensation yet.

After I wrote that last thing, I got so mad, i called my attorney to vent at him (BTW, dont ever use Bales in St Pete). I guess this whole time Ive been misunderstanding something.

the policy for the wheelchair company covered them for $100,000. That doesnt mean anything to me really. That number is just what All State will pay before the wheelchair company has to open their checkbook. Say my neck was broken and I asked for $150,000 and after all was said and done a jury approved it. All State would pay $100,000 and the Wheelchair company would have to pay $50,000.

See I thought that because of the premium the wheelchair company paid to AllState, they would pay up to $100,000 in damages. it doesnt work like that though.

AllState is going to fight like hell and prolong this as long as possible. This is why their offer is so low. Even if they know I have a solid case against them. The law lets them drag their feet. Its BS in my opinion.

Theres no good solution to fix this. It will always be crappy because of fraudulent cases, bad attorneys and corrupt politicians.

Ya, it sucks because I'll never get what I think its worth to me. The attorneys will make out and the medical industry as well. Im thinking I'll be lucky to walk away with (in my own pocket) $35,000 when its all done. Its not worth the pain Ive been through and I wouldnt wish it on anyone.

what sucks even more is that Im told that if I have surgery on C-4 & 5, it makes my case worth 10 times the amount. As soon as you go under the knife, it changes things. It makes me wonder how many people get unecessary surgeries and risk infection and death in order to elevate thier cases? Its a sick ass society we live in sometimes...

I still work most everyday thank God. When I ws on disibility after the accident, I got 66 1/3 of my pay calculated from the previous 12 months.

It wasnt too bad but I still had to use some of my stock and take a "hardship" loan from my 401k to get through. That really sucks because I'll never see the real value of that back.

Yeah but if you truly believe that your injuries are worth more than you will get...don't settle! let it drag out over years if it has to...eventually you will get paid...what you think its worth...

Thanks for the encouragement..... its cool. I know it sounds so "cliche" but Im really glad Im for the most part ok. I can still work and do stuff with my kids. some people cant say that after being hit by a truck doing 40. The mustang was impressive with the way it absorbed the impact... a credit to Fords engineers.
