Odometer fraud questions


Ok 1st the back story. I've been posting bits and pieces of this story in the v6 forum for a while but i wanted to post it here for more opinions.

I bought a 97 v6 mustang in may. When i bought it the guy said it runs fine and it's a good little car but the brakes were bad. I test drove it a little anyway to see how it ran and it appeared to run fine. Well i found out fast that the speakers were all broken/disconnected except 1 and the headlights were bad. No big deal right? Well i left it sit for 2 weeks til i got the money to have new brakes put on. When i did my mechanic told us that the odometer was broken. We asked the guy we bought it from about it and he said since it was so old it was exempt. Well that didnt bother us until 2 weeks later when it started to over heat. That was i believe in the middle of June. It hasnt run right since. I put a new themo in it and bled the system. Well it ran ok for about a week and a half, 2 weeks, and then it started over heating again and it seemed like it didnt have any power to it. Well We finally called the guy we bought it from and he had it towed to his mechanic and he "fixed a hole in the radiator" well the other day i went to pick it up, paid him $200 and drove off. Well i got 10 mile down the road (i live 45 minutes away from this shop) and it over heats again. I had to go back and have him tow it again. I have thought it was the heads fromt he begining and since i've checked everything else i'm pretty sure that's what it is. We paid $6600 for the car. I put down $3500 ($2500 for a trade in and $1000 for an AR-15 rifle) and I refuse to pay another cent.

Now my question is was he right about the odometer exemption? I am thinking about calling a lawyer on the matter but I want my money back. It was a "buyer beware" but the law states that he HAS to give written discloser of the odometer and he is responsible for knowing. What do yall think?

97 is not exempt from oddometer readings my 86 isnt even exempt

I may do that. I have to go to the shop and get my contract out of my car. I may call a lawyer 1st just to see what kind of options i have if i do take that route. Hopefully I can get my $3500 back to put down on a good running mustang. A GT hopefully but a v6 will suit me just fine too

Yeah i've been more than patient with this guy and he has helped us but he has been gettin a lil shitty with my mom lately. She handles most of it because i'm at college most of the time these days.

I feel bad for ya but he did akowledge the busted Odometer, and you accepted the car. Ya he lied about the exemption, but I don't think you have grounds for recovery. But yup it's woth a talk with a laywer.

Ya i over paid but it was at one of those buy here pay here kinda deals. I was lookin on my contract and it says on there "Mileage: EXEMPT"

What makes this car exempt? Doesnt he have to post something on the car? or at least tell me?

I accepted the broken odometer because i wasnt aware i could do anything about it
