Bad Bad Bad situation
Well last night i was cruzing on the local interstate and got a ticket... a 95 in a 55.... yea i'm fucked major. Its only my 1st ticket, but its gonna be a big one. I have to show up to court even...
I wasnt in my stang though. I was in my mom's eclipse, so yeah...

that sucks man. I just got my first ticket the other day too. 31 in a 25. But I got the ticket for carrying a kid in the car and I haven't had my licence 6 months. I even have to show up to court.

i got a 93 in a 45 about 2 months ago. i was passing a friend at the legal speed limit when i saw a car coming up over the hill. i down shifted to 3rd and nailed it. it turned out to be a cop. i went to court and the judge said he could reduce it to speeding but not excessive speed. here is oklahoma excessive speed is 10mph and under and doesnt got on your record.
just tell the judge you dont want it on your record. tell him you will do 15 hours of comunity service if he can get it reduced to excessive speed. what insurance do you have? i have farmers and they dont check your record for tickets/wrecks very often. also the city where you got your ticket isnt going to go out of its way to make sure your insurance company knows. just dont add any cars to your insurance for 3 years and your good. of you play your cards right they might never know about your ticket and you will be ok.

See here in NYS it's all about the money. I've gotten more than one 95 in a 55 tickets. If you are really nice most officers will drop it down low enough where they do not have to tow your car. When you go to court jut tell them you don't want any points. Go in front of the judge, and they give you parking on the pavement with a $250 fine and a $50 surcharge. So much money wasted over the years.

Here's what i'm gonna do. I gonna go in there, tell them i'll do 25+ service hours to get lowered to a lesser charge and have no points on my record. Do you think that will work?

and dont try to make any excuses, just tell them you were speeding and you know it was wrong, if you go in there making excuses it will look alot worse. |

it's not very nice to call people names.
anyway, OP here are a list of points from your state: Two-point Violations * One to 15 mph over the speed limit * Failure to use headlights * Brake lights or signal lights not working Four-point Violations * 16 to 25 mph over the speed limit * Illegal U-turn * Unsafe lane movement Six-point Violations * 26 mph or more over the speed limit * Failure to stop or yield * Following too closely Eight-point Violations * Driving with a suspended license * Failure to yield to an emergency vehicle * Speed contest on road since you have to go to court since you were driving 35mph or more over the posted speed limit. If you want to fight your ticket, you must initially appear in court on your assigned date, and make your plea. A trial date for your case will then be set. If you cannot appear on that date, you must give the court at least five days notice. On the court date, you may either deny the infraction, or plead no contest. Doing the later means that while not admitting guilt, you will be able to explain your version of the incident to the judge. Even if you are found guilty, this in some cases might lessen the amount of your fine. You will be allowed to hire an attorney to represent you. You will also be allowed to bring witnesses. The prosecutor will present evidence to show that you are guilty of the infraction. The state only needs to show guilt by a preponderance of the evidence. This means that you more likely than not committed the offense. This is an easier benchmark to reach than the "beyond a reasonable doubt" standard for criminal cases. For example, the prosecutor will only need to prove by a preponderance of the evidence that you were speeding, not that you were going the speed listed on your ticket. You should also note that you may be placed under oath, and may be called upon to testify. Of course, you will be responsible for any attorney fees. Indiana motorists may volunteer to take a driver improvement program (DIP). Generally speaking, you may complete a home study workbook, video or Internet class, or go through classroom instruction. Exceptions would be if you're required to take a course or the court or BMV specifies that you must take a classroom course. The DIP classes cost no more than $45. If you successfully complete a DIP, you will receive a four-point credit on your license that will remain there for three years. However, this does not mean those points will come off your license. It only pushes back the point at which you'll lose your license by four points.

They may not do it for 40 over, but in Indiana you can go to the prosecutor's office and pay a little more and they won't report the ticket to the state or your insurance. No points off your license. No increased insurance rates. They put you on probation and if you get another ticket in their county they will process both. You can only do this for one ticket at a time in each of the 93 counties.
If you do get hit for points on your license. You go to Blockbuster and rent the Department of Motor Vehicle defensive driving tape for about $35. You take the test on-line and get points back. Your insurance premiums take a hit, but you get the points back. My son has managed to keep his license through multiple speeding tickets. By doing both. He has watched the video three times.
