So Tuesday of last week, I have a final hearing for my divorce. I pretty much get the rough end of the sex stick.
If you want details, I'll tell ya.
So we have everything all set up nice and neat. Judge calls adjournment. We stand, the bailiff comes over and states "Mr. Hunt, I have a warrant for your arrest." I look at my lawyer and ask "What the fuck is this for?" He shrugs and walks off. WTF?!?!? Asshole!! I pay you to keep up w/ this shit!

I am in custody and the bookie is pretty cool. He lets me use his phone to make a few calls. We find out that I had a court date for my probation violation. In July... I NEVER got anything from the county or my lawyer other than a letter stating that there is a motion to revoke my probation. Hearing date was never set. Or if it was, I was not advised of it. Again, either by my attorney or the prosecuting county (PC).

The arresting county calls the PC to find out what the charges and bond are. They (PC) have NO clue who I am or why I'm in custody. They play phone tag for about 2 hours. I find out that I have a court date on the 30th of this month (tomorrow).
I ask the bookie to find out when I'm getting transferes. He calls the PC back and they tell him, and this is wuoted directly from the sherrifs deputy "Who?"

The fucks lost all the paperwork on me and still had an active warrant out w/ my name on it. Dumbasses.
It cost Ame and I $1000 to get my ass outta the pokey for a few days.

My sentence is 60 days. Its a misdemeanor Class D I think.

Odds are what that they will execute the time served??

P.S. My ex-wife's attorney was the one that alerted the county that I had a warrant...

Yup. I wonder if the county fails to have a paper trail and executed a bogus warrant, should I persue charges against them?

if you didn't know, it's the courts fault.

I would use it as the reason for missing the assesement date

When the original sentence was placed, if there was anything else they needed, would they send the paperwork to me or my lawyer or both?

I got a letter from my lawyer staing that if I wanted his representation, his fee is $500. I got a letter from the PC saying there is a motion to revoke my probation. Thats the onlt corrospondence I have recieved from either party. Then, next thing I know, I'm in jail on a warrant.

If never was notified of a court date that I was to go to. From either party. PC or my ex attorney.

granted that you didn't receive any other info but that was your blooper.

there will always be a date and time attached to a hearing. a motion always includes a hearing.

I would explain your case to the judge and hope for the best

sounds to me like theres enough fubar for a judge to give a little. Don't expect it though. Prepare for the worst, and hope for the best. Good luck man I hope everything goes through smooth.
