am I missing something here? why are you and you daughter at your parents?..why the hell is that thing(wife) still in the house?...put her ass out...with your daughter being in your care seems she's to self indulge in her self..a judge would think twice on her being in the house and you two not in the house becuase your daughter needs to be in familiar surrounds like her house to cop and to make it more normal at any rate....so put her ass out and let her suffer..good luck

thanks for all the support and advice guys, this is why this forum is like home for me. still undecided on whats to come. but she is begging me to come back to the house. I told her no, because I need to sort everything out, what I want and whats best for our daughter.
