Would my record go against me?


For those who have read.

Problem. :[ (need serious advice)

Now, I was thinking. Could I challenge that in court? There were 5 cars speeding in a group and he says he clocked me doing 60 in a 45. Now, couldnt I argue that he could have clocked one of the other cars doing 60, seeing as I dont think I broke 55. While yes, I was speeding, it would be a cheaper ticket.

Would me record go against me seeing as I already have 2 speeding tickets?

yes you can challenge that.... and tell the judge just what ya said here. say "I WAS over the limit but not 60 mph.... I am pretty sure I was going just over 50.

Just go in and be cool and you may catch a break!
And no they wont use your previous speeding against you. I have had hundreds of tickets in my time and its not like they pull your whole driving record for court.

the worst they could do if you are polite and admit to speeding and say it was 55 not 60 would be to pay the full fine. id go ahead and try to fight it.. the end result will be the same or you may catch a break

Well, I have seen guys challenge a ticket before in strange ways. One that comes to mind reminds me of your situation. Guy was in a red Porsche and got pulled over while driving amongst a group of cars all traveling at the same speed. Was issued a citation for speeding. Went to traffic court and contested it, and his defence was that he was being targeted unfairly by the police because he was in a nice sports car (remember the red Porsche). Guess what? He ended up getting the charges dismissed, but said he was given the hairy eyeball by every town cop there for about 3 months following it.

Now, as to your situation: You could try and argue that you were being unfairly targeted by local law enforcement because you are driving a sports car, were selected out of a group all going the same speed and none others were cited, despite obviously breaking the law.


BTW, quit speeding on Main. You want to run it, try 2802.

Downlen was calling my name that night, haha. I think im going to try to challenge it. I was surrounded by a 2004 honda accord, a stock 6er stang, and a friend of mines jeep. The cop heard mine above all other things, haha.

Plus, if the cops give me looks, oh well, I live in Lumberton! haha.

I would try and challenge it, its crap and from personal experience the judges dont like cops. They butt heads all the time, or have you thought about getting a lawyer? You can get the ticket deffered(sp), it costs some $$ but it doesnt go on your record.

no because then you were tail gating if he accidently clocked another car and your in even more trouble

in a chain of speeders the last one gets in trouble since you were the one who was egging the cars in front to speed in order to avoid getting tail gated

just my .02 and since your under 18 then you screwed :/

What if I had been in the front. Because I kinda was...haha. Then it looks like im the person causing the group to speed. Isnt it a lose lose situation?

no if your in front you were being tailgated by 5 cars and in order to avoid it you sped up assuming there was no other lane to pull into

Yea just be honest with the judge, tell em you dont think its right that you were picked out of the group.

I told my parents I was in back thinking it might make it sound like I was trying to aviod speeding, but I might tell them what really happened so I can try to fight it with that.
