So, a big rig with a 53' trailer decided to use my car as a speed bump today.

So, I was dropping off my supervisor at a place near work to pick up one of our trucks. After I dropped him off I started to go back to work. A truck was in the middle lane of a 4 lane road, no blinker on or anything. I figured he was going straight through, so I went into the right lane to make a right hand turn. Well, I was about 6 feet from the stop sign when the truck started to cut in front of me. I had no time to go into reverse so in a last ditch effort I laid on the horn hoping he would hear me and stop just in time, well he didn't. The trailer hit me. His rear tires caved in my door completely and damaged my rear quarter panel, the bottom of his trailer hit just above my window, putting about a 3" deep gouge into the metal there.

The driver tried to claim that I was out in the intersection already and backed my car up after I hit him (that's what he is claiming). I told him he was full of shit considering his truck dragged me about 6 feet into a curb. After the accident all I did was pull up the emergency brake, and call work.

Body shop said the car is undrivable in it's current condition and by visual estimate without actually going over the car, he is thinking around $6,000-$7,000 in damage, and that is if nothing internally is damaged from him dragging me into the curb. I'll post some pics tonight, my brother has the cell phone with all the pictures and he won't be home till around 6:00PM MNT.

Well we went to the police station, filled out all the paper work (statement, etc.). The officer then told me it was up to the insurance companies to decide who is at fault.

that doesnt seem right, was either of you issued a ticket? i know in texas who ever gets the ticket is at fault.

Could you see his side mirror? If you could see his mirror, then he could have seen you had he looked. Also if you were up by his rear wheels - you were in his lane and even if he had turned his light on before he turned, you probably wouldn't have seen it if you were that far past his rear - did you notice the side flashers on the trailer?

If he was planning to turn right from the center lane - that's a no no in the states. The correct way to make a right turn in a tractor trailer is to get into the right lane and make a wide right turn. Find a drivers manual at your local BMV and look it up.

Then prepare for the battle with your claim rep. Educate yourself before having the conversation and you'll be fine.

Well that first pic shows where it happened (I was about 6-8 feet further back and that is where he dragged me to). I'll upload the pics of the side of the truck where I was hit by.

In this one you can slightly see where the trailer of the truck hit my car by the paint transfer and small bends in the metal.

In this one you can see the paint transfer on his trailers rear tires. The tires are about 2 feet from where the other picture is.

Ow, sorry to hear man, glad you're physically unharmed though. Those situations with the insurance and no witnesses can be tough. The police have their hands tied if they didn't see it and it wasn't like 99% obvious. Speaking of obvious, his lack of a turn signal for the turn will be a big factor in the at fault ruling.
