so i got this job last week at a halloween place but it ends on the 3rd

decent hours and ok pay but everybody gets pissed about breaks. they dont give us any and our employement book thing says at 4 hours they are required to give us 10 min and at 5 hours they half to give us 30 min

now idc bout the 30 min cuz its unpaid but i do care about my fucking 10 minute break

every day for 30 min one of us (we take turns) has to hold a sign

well today 5 minutes b4 my break was surpose to come they tell me its my turn to go outside. im pissed but dont say anything or complain. i take my phone with me 2 c the time becuase they NEVER say when its time to come in

then half an hour comes and the bicth says "you were on your phone so i clocked you out and your done for the day"

i was outside in the frezzing fucking cold not getting paid when by state law i was surpose to be on break

should i call human resources since thats what are book says to do if we dont get our breaks?

Im so fucking pissed and so are the other 9 employees about not getting our breaks. one lady worked an 11 hour day and didnt even get a day

I'd call human resources. That's fucked up. They BY LAW are not allowed to clock you out themselves. You are supposed to clock YOURSELF OUT under their supervision. Even myself as a manager (at both restraunts) am not allowed to do that. It's against the law.

You were ALSO working while not being paid. Again, against the law....

You could definitly take that up with human resources. Also, legally, no one can clock you in or out without you knowing.

you will get paid for half hour, so thats 2.67 more in your pocket, i would say the extra time on the phone dealing with the shit is not worth 2.67. Find another job.

exactly wat i was thinking. its not like its really gonna help me. im not gonna sit on the phone for 2 hours to get paid for 30 min

a place I used to work at (as a receptionist) required me to work during my lunch hour.
I still had to answer the phones, while eating my lunch. and I was not to be paid for it.

Unfortunately there is not much you can do in reality, its a huge huge huge pain in the ass to get anything done because honestly.. most people don't really give a shit about some crappy part time job.

How do you or them PROVE that you are on break? I mean they can prove you're on the clock, but how can they prove your on break? By the constant clock out times? Is that the way they keep up with it there?

Holy shit, i couldn't of said it any better myself AB. If you have to work 3 jobs just to pay for gas and still can't afford to fill your nitrous that you wanted so bad and can't afford to go to the track i think you have your priorities kinda messed up. Sell the car, sell the mods off of it, by a beater, get whats called a savings account.
