Another addition to the story of my car that couldnt.....


Well some of yall have read the other posts i've made about my car and it's over heating problems. well here is the latest for those of you who care.

Well my car over heated a few weeks ago again and the guy we bought it from agreed to have it towed to his mechanic to have it looked at. Well the mechanic said he found a hole in the radiator and it was now running fine. Well we had to wait a couple of weeks to come up with the $200 he wanted for the patch but today we went to get it.

We paid him, I got in, drove off, Got maybe 15 mile down the road and it's over heating again. I ended up sitting along side the road for about 20 minutes waiting for my mom to finish looking around town. We live 45 minutes away from this town so i was stuck there.

Long story short the mechanic is going to tow it again (which he will probably charge us for that too) and take another look.

Now my question to all my v6 friends is.... What do i do now? If the heads are blown I cant afford to fix that. Should I just tell the guy i bought it from to fix it or shove it up his ass or should I just bite my tounge and pay it?

Back story: I've had this car since like the end of may and it has yet to run properly. We payed $6600 for it and it said it had 89k miles on it but we found out later that the odometer doesnt work, it had bad breaks, and no speakers, and broken headlights. We knew about the headlights, speakers, and breaks though

the sold "as is" doesn't apply to the odometer.

thats a breach of contract right there.
the sold "as is" doesn't apply to the odometer.
We asked our mechanic about that and it says that older cars arent bound by that in alabama. I may call a lawyer to see what my options are

hhhmmm i'll look into it a little farther. We are supose to call the mechanic monday to see what is "wrong" with it. Personally i think the mechanic may be crooked but maybe i think that just cause i'm pissed off about it all.

Oh my normal mechanic is great. It's this dealership mechanic that the guy we bought the car from had the car towed to that's the one that's stupid.

I kept telling my parents that 6600 for that car was way too much but she said that's how much your going to pay at a place like that. At least i learned my lesson

^^i got my 2000 v6 with 79k miles for 6000 flat. the only thing wrong was that the door locks didnt work. 100 bucks for the actuators and installed them myself. you overpaid

Yeah I got fucked..

What i'm tryin to figure out now is if i can still get out of the contract if the seller didnt know the odometer was broken.

I looked up the laws and it says"

1. (It shall be unlawful for a person) "with intent to defraud, operate a motor vehicle on a street, road, or highway if the person knows that the odometer of the vehicle is disconnected or not operating; or

2. The owner of the vehicle or agent of the owner shall attach a written notice to the left door frame of the vehicle specifying the mileage before the service, repair, or replacement and the date of the service, repair, or replacement.

3. A person transferring ownership of a motor vehicle shall give the transferree the following written disclosure

A) Disclosure of the cumulative mileage registered on the odometer,

B) Disclosure that the actual mileage is unknown if the transferror knows that the odometer reading is different from different from the number of miles the vehicle has actually traveled.

Number 1 is what's bugging me. Is that saying that if the seller didnt know it was broken im fucked?

When you went to the BMV to take the title of the car (or if you did it at this guys house, dealership, whatever) did you sign something that had the mileage written on it at that time?

Well if you did, thats all you need. If it had XXX miles written and 4 months later it still has the same XXX miles on it, theres your proof of him breaking the law.

All other problems aside. Like HMUSN said. I think these things fall under Federal law not local. You cannot sell a car knowing the odometer has failed. The title will prove that it was and doesnt work.

The mechanic your using sucks BUT you where misled when you bought it. Get an attorney and he/she will tell you what to do. GET YOUR MONEY BACK and buy a good Mustang. Also, I hope you were saving every reciept from every little repair. Make a log of the time you spent on the side of the road and any other time you spent messing with the car. These are damages that can be recovered in court or mitigation.

Do yourself a favor in the mean time. STOP driving the car. It is not DRIVEABLE. Get a rental car and save the reciepts. Ask someone to drive you around and have them make you recipts for their gas and time. That car is not safe to drive. It is not fixable and you have the proof.

Lemon Law if you can get a mechanic to show that it in fact has had a blown head for a long time IE since before you bought it. he will legally have to buy it back from you.

Yeah i believe on the contract it did say the same milage. I'll have to look again to be sure. I havent been able to drive the car hardly at all. I took it on a couple road trips when i 1st Got it and it was fine but after about 2 weeks it craped out. I thought i had fixed it when i put a new thermo in and bleed the system but after about 2 weeks it did it again and that's when we had it towed.

I'm going to try to get a GT next time though

I was talkin with my mom today and she said that she mentioned the odometer being broken to him when it broke and said that since the car was so old it was exempt. Now i dont know about yall but that sounds like a load of shit to me. Anyone know where i can check that?

On a side note you need to get a road side assistance membership like GM roadside. Its like $70 a year ,covers everyone in your house and they give you a unlimited towing distance and they will help you no matter what car your drivin . Even if its not yours.
